Privacy Policy

This Privacy Policy explains what personal information Construct Enterprises LLC ("Construct," "we," "us") collects when you use ND-Pi (the "Software") and our related websites and license services, why we collect it, who we share it with, and the rights you have. We do not sell your personal information.

Your video stays local. ND-Pi previews and switches your NDI and RTSP sources on your own device and network. The video, streams, and their content are never sent to Construct and never leave your network through the Software. We only handle the account and license information described below.

1. Information we collect

We collect only what we need to license, deliver, and support the Software:

We do not receive the video, streams, or media you preview or switch with the Software. That content is processed locally on your device and network and stays there.

2. How we use it

We do not use your information for third-party advertising, and we do not sell or "share" it for cross-context behavioral advertising as those terms are defined under U.S. state privacy laws.

3. Legal bases (EEA/UK users)

Where the EU or UK GDPR applies, we rely on: performance of a contract (to license and deliver the Software); our legitimate interests (to secure and support the services and prevent abuse); legal obligation (tax and accounting); and, where required, your consent.

4. Who we share it with

We share personal information only with service providers who process it on our behalf under appropriate confidentiality and data-protection terms:

Stripe is different. Because Stripe is the merchant of record for your purchase, it is not one of our processors: it determines its own handling of the payment and tax data you give it, as an independent controller under its own privacy policy. We exchange with Stripe only what is needed to fulfil and support your order.

We may also disclose information if required by law, to protect our rights or the safety of others, or in connection with a merger, acquisition, or sale of assets (with notice where required). We do not sell your personal information.

5. On-device data

The Software stores data locally on your device — for example, your source list, presets, and a cached copy of your license status — so the app can function, including offline during the grace period. This local data, and the video and streams the Software handles, stay on your device and network.

6. Retention

We keep account, license, and activation records for as long as your license is active and for a reasonable period afterward to support renewals, recovery, security, and legal, tax, and accounting requirements, after which we delete or anonymize them. You may request deletion as described below.

7. Your rights

Depending on where you live, you may have rights to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent. Because we do not sell or share personal information for advertising, there is nothing to opt out of in that respect. To exercise any right, email construct.ent@gmail.com; we will verify your request and respond as required by law. You also have the right to lodge a complaint with your local data-protection authority. We will not discriminate against you for exercising your rights.

8. Security

We use technical and organizational measures appropriate to the sensitivity of the data, including encrypted transport, scoped credentials, and license keys that are validated server-side. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. International transfers

We are based in the United States, and our providers may process data in the United States and other countries. Where required, we rely on appropriate safeguards for international transfers. By using the Software, you understand your information may be processed in the United States.

10. Children

The Software is a professional tool intended for use by adults and is not directed to children under 16. We do not knowingly collect personal information from children.

11. Changes

We may update this Privacy Policy from time to time. We will revise the "Last updated" date and, for material changes, provide additional notice where appropriate.
